NOTES & LEGAL ISSUES
Rates are shown for units of 30 seconds or less for each separate use
of each music title. It should be noted that durations must not be
totalled; our rates apply to each separate use of each music title,
even if it is used several times within 30 seconds: i.e. one 5-second
fanfare used four times within a 30-second segment would count as FOUR
SEPARATE 30-second units.
1:
Music supplied by us is copyright material and a licence for
synchronization, re-recording or dubbing must be obtained from us. We
reserve the right to charge rates higher than those quoted when
unauthorized use takes place.
2: On
receipt of your completed Report Sheet, we will send you an invoice for
the use of the music. When we receive payment for that invoice, a
synchronization licence will be issued to you. A copy of this licence
should be retained by you and copies should accompany every print or
copy of your production distributed. The licence should be held by the
producer - not the accounts department.
3: The
rates shown apply only to those categories specifically mentioned on
the rate sheet. Quotations for any other type of use or combination of
uses will, where possible, be given on request.
4: Cable-TV usage is charged at the same rates as Free-TV. This does not include any Pay-TV use.
5: When
additional clearance (for upgrading) of music rights for a particular
production is required at a later date, the full rate of the additional
clearance applies. For example: To upgrade clearance from "single
country" to "USA plus single country" you must add the full USA only
rate.
6: Details
of music used must be supplied to us within 48 hours of completion of
the production. Music Licence fees are payable on receipt of our
invoice. Delay in requesting music clearance could result in a higher
licence fee being charged.
7: If
your production is scheduled for broadcast or theatrical use, the full
details of your licence must be sent to the performing rights society
in your country together with a complete cue sheet detailing all music
used in the production.
Examples of Performing Rights Societies In USA: ASCAP and/or BMI In Canada: SOCAN In England: PRS In France: SACEM In Germany: GEMA
8: All
licences are in perpetuity. However, any revisions in the form of
visual, narration or script changes, different language versions, or
new versions of a production utilizing our music, constitute different
productions and require additional clearances.
9: All rates shown apply to non-exclusive use only.
10: We reserve the right to change prices without notice.
11: No lyrics may be added to any music without permission.
12: Videorecords are licensed subject to the rules and regulations of other countries.
13: Theatrical
clearance refers to use before a paying audience. Non-Theatrical
clearance refers to use before non-paying audiences.
14: Series themes must be licensed for each episode unless other arrangements are made.
